Land Owners! Have you really thought of the consequences of signing a lease?  Part II

Part II
​You own the land BUT!- 

 YOU ARE ALWAYS RESPONSIBLE FOR WHATEVER HAPPENS ON THAT LAND!
 
You need to think more than money…think liabilities.

Regulations: 
If the solar company has any issues with regulators, environmental issues and/or other problems, they can declare bankruptcy and walk away from the project.  Regulators can shut down a facility for noncompliance.  The land owner is responsible for any environmental issues, should it affect neighboring land owners. 
 
Limited Liability Corporation
The solar company can set up a single corporation just for the land owners site.  This is a red flag.  The originating company can walk away at any time, going bankrupt and leaving the land owner to clean up the site, pay to remove all materials as well as pay all taxes associated with the property and outstanding liens on the property.  Any problems, such as contaminated ground water, carcinogens, flooding issues, erosion of soils, etc., now are the land owners problem and/or are passed onto he heirs.
